Avant of Canada, LLC, its affiliates and subsidiaries (“AvantCredit”), have provided this Privacy Policy to describe our personal information handling practices, and to assure you of our continuing commitment to protect all personal information that we handle in the regular course of doing business. This Policy answers some of your most frequently asked questions, and lets you know exactly how we’re protecting the information you entrust to us. AvantCredit may amend this Policy from time to time. What personal information do you collection about me?

We limit the amount and type of personal information collected to that which is necessary for our identified purposes, and we collect personal information by fair and lawful means.

We collect the following information about you:

  • Name and contact information, including mailing address, telephone number and email address;
  • Additional information for identity matching and credit check purposes may include information such as occupation, name of employer, income, assets, liabilities, previous address, number of dependents, Social Insurance Number (if provided), date of birth and driver’s license number;
  • Information about the account or loan, such as current and historical account or loan information, balance and indebtedness, account transaction history and similar information, and records relating to the handling of any inquiries or complaints;
  • Payment-related information, such as banking information; and
  • Such other information we may collect with your consent or as permitted or required by law.

When you visit our Site, we also collect:

  • Information about your device, including your IP address, the type of operating system and browser you use, and your device’s location;
  • What pages you visit on our Site and what links you click on; and
  • What other sites you’ve visited recently.

How do you collect personal information about me?

We collect personal information primarily from you, for instance through applications and supporting information and documentation you provide. We may also collect personal information about you through your ongoing interactions with us, from references, employers and other financial institutions you have identified in your application as well as credit bureaus and other third party sources. For example, we may collect personal information from credit bureaus in order to verify your current and ongoing creditworthiness and other information you may provide to us.

How do you use and disclose this information?

The main reasons we collect personal information from you are:

  • To manage and promote the business activities of AvantCredit;
  • To verify identity and other information provided by customers and determine eligibility for products and services;
  • To open, administer and service accounts and loans and to provide and administer any requested products or services;
  • To evaluate current and ongoing creditworthiness and other requirements and to determine customer eligibility or suitability for products or services offered by AvantCredit;
  • To advertise, market and promote AvantCredit’s products and services to customers who have not opted out of such communications,;
  • To establish relationships, provide quality service to and communicate with customers;
  • To collect outstanding debts;
  • To protect the business interests of AvantCredit and its customers, including to detect and prevent fraud and other unauthorized or illegal activities;
  • To maintain business records for reasonable periods to meet legal and regulatory record retention requirements; and
  • For any other purpose with your consent or as permitted or required by law.

AvantCredit may disclose personal information to our affiliates and non-affiliated third parties in a number of circumstances including:

  • To credit bureaus, credit reporting agencies and to your current or future creditors for the purpose of maintaining your credit history and providing credit references;
  • To financial institutions for payment processing purposes;
  • To enforce your contracts with us and otherwise for the collection or payment of a debt owed to us;
  • For the purposes of detecting and preventing fraud;
  • In connection with audits (internal or external), management, billing or administrative purposes including defending and bringing legal actions;
  • For the purposes of meeting legal, regulatory, industry self-regulatory, risk management and security requirements;
  • To any person or entity to which we have assigned or transferred an interest in your account or any debit or interest due under the terms to be provided in the Agreement, if approved, and/or any of our rights and obligations under the Agreement (including any subsequent assignee or transferee);
  • Unless you have opted out, to affiliates for marketing purposes such as:
    • To assess your ongoing needs for loan products;
    • To assess your needs for other financial products;
    • To inform you of special promotions or products;
    • To enter you in and administer free promotional contests that we may offer from time to time, and if you win, to identify you for promotion and advertising purposes; and
    • to enable affiliates to offer you additional products and services; and
  • For other purposes with your consent or as permitted or required by law.

AvantCredit has a one loan per household policy. As such, if you receive a loan, and another household member subsequently applies and is declined, the declined household member may be informed that they were declined because we have a one loan per household policy.

AvantCredit’s website servers that support the Site, as well as many of our operations, are located in the United States. Additionally, many of our affiliates and non-affiliated third parties with whom we share your personal information may be located outside of Canada, and as a result, your personal information may be transferred across borders and it may be accessible by foreign governments or law enforcement agencies.

How can I manage the collection, use or disclosure of my personal information?

We will not collect, use or disclose your personal information without your consent, except where required or permitted by law.

In order to provide you with products and services, it is necessary for us to be able to collect, use and disclose your personal information for certain clearly identified purposes. By submitting your personal information on our Site, you understand and agree that we may use your personal information, including the phone number, email address or postal address you provide to us to contact you by mail, email, SMS (short Message Service) i.e. text message, and telephone (including by using automatic dialing and announcing devices). Subject to certain legal or contractual requirements, you may withdraw your consent to the collection, use or disclosure of your personal information by us at any time using the following methods:

  • Unsubscribe from email communications by clicking the “Unsubscribe” link in an email communication and submit your email address on the next screen.

If you withdraw your consent to our use of your personal information, we will honour such choice once we have had a reasonable opportunity to process your request. We reserve the right to take reasonable steps to authenticate your identity with respect to any such request or other inquiry. If you withdraw your consent, we may be limited or unable to provide you with certain services or information. If you wish to continue to receive the services that we provide, even if you withdraw consent, we may still need to share information we collect about you with our affiliates and non-affiliated third parties to facilitate providing our services to you, to administer our business, and as otherwise permitted or required by law. We will only transfer your personal information to non-affiliated third parties for marketing purposes with your express opt-in consent to do so.
